It was an old fashion “whooping”

This morning our good friend Foggy (Bill Bryan) appeared on the radio program “The Immigration Hour” with Georgia immigration attorney Charles Kuck. The program streams every Tuesday on the America’s Web Radio Network out of Sandy Springs, Georgia. Professor Kuck’s guest last week was DUI attorney Mario Apuzzo who fancies himself a constitutional authority. Last week Kuck sounded as if he not prepared to counter Apuzzo’s nonsense “two citizen parent” theory for natural born citizen. Today’s program was a different story. Foggy had requested a spot on the show and Professor Kuck agreed. Kuck had obviously boned up on the subject and quoted extensively from the key cases such as Lynch v Clarke and Wong Kim Ark. He agreed that Apuzzo was wrong on every point especially his flawed reading of dicta from Minor v Happersett.

Kuck said he would be glad to come on a future Reality Check Radio program to discuss immigration reform. He also said he would like to have Bill back again to discuss the eligibility issue some more. Kuck had briefly become a hero for some of the Birther blogs but we suspect they will ignore this follow up show where he essentially tosses Mario Apuzzo under the bus.

Indiana Birther Paul Guthrie lost once again in the Southern District of Indiana federal court when Judge Sarah Evans Barker dismissed a re-filing of his case against President Obama and a long list of other government defendants in which he claims that President Obama is a King and not a natural born citizen because according to “natural law” citizenship only passes through the father. Guthrie, who calls himself “Jedi Pauly” on his blog had filed his original case in the same jurisdiction and it was quickly dismissed by Judge Jane Magnus-Stinson who is an Obama appointee. The Jedi was mightily offended that an Obama appointee and a female to boot would dare to dismiss his case so the filed again and added Judge Magnus-Stinson as a defendant. Through a cruel twist of fate Guthrie again drew a female judge; this time the Reagan appointee Judge Barker

Judge Barker issued an order on April 3rd asking Guthrie to show why this nearly identical case should not be dismissed on similar grounds as his previous nutty case and explain why it was not frivolous. Guthrie replied on April 17th with a 148 page filing chock full of his kooky “natural law theory” legal nonsense  to explain the definition of natural born citizen as used in the Constitution. Unlike the Vattelite Birthers who believe that a child must be born on US soil and both parents must be US citizens to become a natural born citizen Guthrie believes it is only the father’s citizenship that counts. Guthrie’s response was bizarre even by Birther standards and included a discussion of Judge Barker’s reproductive capabilities.

Judge Barker was not impressed. Yesterday she issued an order dismissing the case again. First she explained to Guthrie that trying to sue a sitting judge for a decision he didn’t like was a “complete non starter”. Judges have absolute immunity for rendering decisions without fear of retribution from unhappy litigants like Guthrie. This is one of those foundations of our system of justice that seems to escape comprehension by Birthers like Guthrie and Orly Taitz who think that judges have almost unlimited power to do their bidding and if they refuse it is because they are either bought off, being blackmailed, or are traitors. In this case Guthrie had added Judge Magnus-Stinson because it he thought she was a “de facto” judge as an an Obama appointee and should have recused herself because he had not given her permission to judge his case. I kid you not. Guthrie actually said that in his filing on April 17. He also accused Judge Magnus-Stinus of committing a fraud upon the court for dismissing his case.

Judge Barker had no trouble finding failed Birth cases to cite in her ruling that the court lacked jurisdiction to remove a sitting president and that Guthrie laced standing. After all there are 201 of them now. among the oldies but goodies she cited were Kerchner v Obama, Berg v Obama, Sibley v Alexander (DC District), and Taitz v Obama (DC District).

I recently invited Mr. Guthrie to appear on RC Radio. He declined.

Hendershot has spent hours trying to dig up dirt on the Obama’s and was the one who found the the name “Harrison J. Bounel” linked  to the Obama’s South Greenwood Avenue property in Chicago and what may have been President Obama’s social security number. Hendershot’s blog posts about Bounel have found their way into Orly Taitz’s pile of poo that she routinely deposits along with her cases in courts ranging from California to Mississippi. What Hendershot will not tell you is that these databases like Acxiom are rife with errors and include every possible connection from various sources such as government data, public data like marriage, death, and property records, credit records, and consumer data. Much of this data is unverified. It is up to the user to validate the data obtained from uses of these data bases.

If you think these databases are accurate think again. This is a typical disclaimer:

They will not guarantee accuracy and all of them have similar disclaimers to that effect. Remember when Neil Sankey ran searches on Lexis Nexis and found numbers of different addresses and social security numbers for Barack Obama and listed Stanley Ann Dunham’s gender as male? Neil Sankey search of Barack Obama’s address and SS number Neil Sankey reportedly lost access to Lexis Nexis for conducting searches on the President. These searches helped launch Orly Taitz on her non-stop manure spreading campaign.

This is not the first time Birthers have gotten in hot water for poking around where they shouldn’t . Greg Hollister got a visit from the authorities for impersonating the President to obtain a copy of his draft card.  Linda Jordan received a visit from the Secret Service after she improperly accessed the Social Security eVerfiy self service system.

Hendershot seems to have toned down his rhetoric since he posted this  few weeks ago in a reply to Doctor Conspiracy on Hendershot’s blog:

I am not being a smat-ass in any way towards you, but I can show you how accurate these databases can be. You would be amazed at what I could find on you.

BTWIf I had my way I would drag all of the OBOTS out in the street and tear their Socialiist hearts out. There is nothng nice about me as a person. The one things I love about Skip Tracing is finding out where these slug debtors live and paying them a visit especally when they have threatened me over their debts and hoping that they have a gun so I can use mine. Unless some sort of charges are filed as a result of the FBI action we will probably not know what it was about. The FBI and real law enforcement agencies unlike the Mike Zullo’s Clown Case Posse do not go on Birther radio programs or hold news conferences with faked evidence to talk about their investigations.

Hendershot was one of several Birthers who filed ridiculous ballot challenges against Barack Obama in 2012. He filed a motion against the Alabama Democratic Chair Mark Kennedy to try to prevent the party from naming Barack Obama as their candidate. The case was dismissed after a hearing held before Judge Helen Shores Lee on January 9, 2012. This was one of at least three such challenges filed in Alabama. Hendershot tried to get a stay on the case to allow Orly Taitz time to seek admission in Alabama to represent Hendershot. Judge Lee would have no part of this. The Democratic Party was ably represented by attorney Barry Ragsdale who appeared as a guest on RC Radio on January 17, 2012. Barry discussed this and several other cases in which he successfully defended the Democratic Party.

Freaky Friday

Mike Zullo, the lead investigator for the Sherriff Arpaio’s Maricopa County Cold Case Posse, appeared yet again on his favorite radio show last week. Zullo spent a full 90 minutes with Pastor Carl Gallups on his  weekly “Freedom Friday” program, which is broadcast on the web and on a small AM station in northwest Florida.

Gallups had hyped the show on the PPSimmons blog and various Birther sites had picked up on the hype for a week and stated that Zullo would release some astonishing new evidence that had been supplied to the CCP “team”. Gallups and Zullo as usual failed to deliver on the hype and there was no “bombshell” or anything new at all for that matter. Gallups made reference to mysterious “VIP’s” who have “come on board” and are “ready to move forward in an official manner”. Of course, none of these “VIP’s” could be named at this time. Gallups said that there were other “VIP’s” who had made promises to do something with the evidence but had reneged on those promises. Gallups promised to out those “VIP’s”. Someone at the Fogbow observed that Gallups’ VIP’s stood for Various Imaginary People.

Zullo took calls for over an hour (interrupted by frequent commercial breaks with ads pushing local yokel businesses that were more entertaining than Gallups’ program).  The calls were mostly Birthers but one Obama supporter managed to get through Gallops call screener to ask Zullo why they did accept John Woodman’s offer to share the results of his hundreds of hours of research into the validity of the LFBC. The caller offered this as proof that Zullo was lying when he claimed that he went into the investigation with no preconceptions. Zullo’s claim is laughable of course. The CCP investigation has never been about the truth but is nothing more than an attempt to slather a veneer of legal respectability on the Birther nonsense claims that someone forged the LFBC that was released to the public by the White House on April 27, 2011.

Gallups cut the caller “Fred” off before Zullo could answer but Zullo became somewhat upset and launched into a tirade against Woodman’s “methods” and claimed that Woodman had never corresponded with the CCP. This claim is false. I contacted John Woodman and he confirmed that he had called the CCP at the number given on their web page and offered to talk to them. No one ever returned his call. Woodman called again when the CCP used the incorrect vital statistics code to try to claim that the wrong code had been used for Barack Obama’s father’s race on the LFBC. John asked for a copy of the source for the codes that were displayed in the presentation last July at a CCP press conference run by Mike Zullo. Again no one contacted Woodman. Zullo also falsely claimed that Woodman gave up the computer business. He has not and is still in business. Woodman retired from blogging about Birthers because he considers the issue over now that Barack Obama has been elected a second time and said there is nothing left to discuss.

George Washington Slept There

Near the end of the program Gallups and Zullo talked about their visit to Washington, D. C. to attend the recent CPAC 2013. Gallups and Zullo had discussed their contact with “VIP’s” at the conference on the program the previous Friday. They said that on the final morning of the trip they toured Mount Vernon, George Washington’s famous estate. Gallups claimed they asked their tour guide if President Obama had ever visited Mount Vernon. Gallups said the guide “looked at us and said Barack Obama is the only President in US history never to set foot on this property”. Zullo and Gallups then used this to smear President Obama claiming that the guide “was almost in tears when he said it”.

I thought this claim sounded odd and of course considering the sources’ track record I assumed it was false. The entire claim is a red herring. How does visiting Mount Vernon equate with patriotism and ones ability to govern? As it turns out my instincts were correct. The claim that Obama is the only President never visit Mount Vernon is bogus. Is it possible that the tour guide was that badly misinformed? Yes, but this story has all the earmarks of a tall tale shaped to fit their anti-Obama agenda.

Yesterday I contacted Mount Vernon and they said the best way to check out this claim was to post the question on the “Ask Mount Vernon” section of the Mount Vernon web site. I received my answer quickly. First, the claim President Obama has not visited Mount Vernon, yet, is correct. However I note that he is only in the very early part of his second term of course. Also, the a new library devoted to the study of George Washington is being constructed and is scheduled to open in September 2013. There is a good chance that the President will be there for the dedication. The First Lady and their daughters have visited Mount Vernon. But what about all the other presidents whom Gallups and Zullo claimed all set foot at Mount Vernon? Well the first president did of course.  As it turns out almost half of the remaining presidents never came to Mount Vernon,  21 in total. Among those who are not recorded as ever visiting are Jefferson, Monroe, Madison, Nixon, Carter, and Clinton.

Unlike Mike Zullo I will name my source. She is Mary V. Thompson. Ms Thompson is the research historian at Mount Vernon. She was kind enough to supply the following information:

As you will see from the list below of presidents who did come to Mount Vernon, there are obviously quite a few who did not, or at least, for whom we have no record of a visit, including President Clinton. In the case of Presidents Clinton and Obama, their wives have visited Mount Vernon.

While there, he cut down a tree about 40 yards from the Tomb for a flag staff for a Mr. Duncan, “who is going to the Holy Land and wished a flag staff from Mount Vernon on which to raise the American flag on his journeys” (March 1851).

President Abraham Lincoln: Made a visit to Mount Vernon on the steamer with some friends and family members (April 2, 1862). John Dahlgren of the Washington Navy Yard wrote that he came to Mount Vernon that day “with the President, some members of his family, and others. I advised the President not to land, and remained in the boat with him.” According to one source, “[a]lthough the property was considered neutral territory during the war, real security issues remained, so it’s unlikely Lincoln visited the estate during his presidency.”

President George W. Bush: Paid a visit with Mrs. Bush on the Presidents’ Day holiday (2/19/2007); came back in November of the same year to meet with the new president of France, Nicolas Sarkozy (Illustration). The meeting was described as follows: “These two powerful allies and a handful of their most trusted advisors sequestered themselves in Washington’s Large Dining Room to discuss conflicts in the Middle East and elsewhere. The press conference that followed had the Mansion’s cupola, with its symbolic Dove of Peace weathervane, as an appropriate backdrop.”

Notice that several previous Presidents visited on special occasions. For example, President Reagan visited on the 250th anniversary of Washington’s birth. George W. Bush only went near the end of his presidency in the seventh year. Are Zullo and Gallups questioning Bush’s patriotism? What about the ones who never went?  How ironic that Zullo and Gallups would either fabricate this story or fail to do even one bit of research to check out a weird claim by a tour guide that I easily debunked and in the process drag in our very first President who supposedly never told a fib.

Where’s the Beef?

The much ballyhooed radio appearance by Zullo with Gallups didn’t play well even with the gullible Birthers who seem to have hung on Zullo’s every  “any time now” utterance for over a year. Here is just a sample or two from Obama Ballot Challenge:

Carl loves to hear himself talk and he is good at it. He had to fill up 2 hrs, less the interminable “breaks,” because Zullo had astonishingly little new material to inform us about. He’s been giving an abbreviated, updated version of his 3-1-12 press conference, for over a year. Step right up, keep those contributions flowing in folks. …Did I listen to the broadcast today? Absolutely not as I believed nothing new would be forthcoming. From what I’ve read, I was correct in my assessment. I apologize to those good folks who have been expecting more and not seeing results. I was told this investigation would be done with the “utmost diligence.” To say the least, I am disappointed how my request is currently being handled. We’re talking about saving America. We’re not talking about putting on a three ring circus act! Nothing has happened in my opinion since March 1, 2012. It’s time to get an active duty MCSO investigator, who is paid by the county to complete this criminal investigation, one way or another. This truly is disappointing.

Of course  this commenter is wrong. There is no way Joe Arpaio is going to put a real investigator on this because he knows it is all a sham and he would have to answer to the taxpayers for wasting any more paid resources on this farce. He already caught flack from the local media and the county board of supervisors for spending $10,000 sending a deputy ostensibly to protect Zullo when he went to Hawaii last year to harass officials there and pester a 90 year old lady, former Hawaii Registrar Verna K. Lee.

Even at the crazy ORYR/Birther Report blog the commenters were asking “Where’s the beef”?

We had a most interesting discussion about the case. Sanders admitted that the case filed by Jordan was frivolous and was really doomed from the start. Sanders said “I don’t think she could get from here to there in the context of this case …”

Sanders repeatedly tried to distance himself from any claims that President Obama was not born in Hawaii or was ineligible. He was not about to be labeled a “Birther”. The following exchanges clearly demonstrate that:

Me:  “[President Obama] produced two birth certificates that were valid. The short form birth certificate that the Birthers made such a hick-hack over is a perfectly legitimate birth certificate. If a sealed birth certificate were presented before your court with no evidence to the contrary and with a letter and verification from the [Hawaii] saying it’s valid, wouldn’t you tend to accept it as valid?

Sanders: “Sure”

Me: “ …. by his birth in Hawaii, you know, and the fact that he’s 35 years old, and he’s been a resident, he was a resident of the country for 14 years before running for President, then he is eligible, correct, if those points are all correct?”

Sanders: “Yes, yeah, sure.”

Sanders also seemed surprised to learn that in preparation for her original case his client had illegally accessed the DHS/SSA E-Verify Self Check system by pretending to be Barack Obama to run a check on a social security number she believed to have belonged to Obama. When I asked him if he was aware of that he said “No, no I wasn’t.”

Sanders also does not buy into the kooky Birther theory that a natural born citizen must have two citizen parents. When I asked him if he bought into that theory he replied “No I don’t ..”

Again Justice Sanders made clear his involvement in this case is limited. He has been hired by Ms Jordan because she screwed up when she filed this frivolous case and now is on the hook for some serious bucks. While I think Justice Sanders intentions are good I cannot in all honesty wish him any success in this particular case. There should be a penalty for such gross abuse of the people’s courts in an attempt to smear our President.

Taitz’s motion requested that the certification of the electoral votes in California be stayed as well as the certification by Congress. Both event have long since occurred as well as the Inauguration of President Obama.

Taitz was not available for comment as I wrote this article.

This denial ends the long string of futile litigation for Taitz. All that remains are a couple of exceedingly stupid and moot cases. One is in Mississippi where Taitz sought to prevent Obama’s name from appearing on the November ballot and another in the Eastern District of California where Taitz is suing to prevent the Electoral College from voting and Congress from certifying the electoral vote on behalf on an unsuccessful Romney elector from Minnesota among other losers.

The only reason for following these remaining silly cases is to see if the judges decide to put an end to this pretend lawyer’s abuse of the courts by imposing fees and sanctions that will put enough of a dent in the pocket book of her husband Yosef so that he decides to pull the plug on the antics of his Russian bride who pretends to be a civil rights attorney. Time will tell. Even the California Bar might wake up some day……some day.

I posted a comment over at Mark Gillar’s YouTube channel the other day. Gillar suppressed the comment but replied via a PM. He challenged me to refute his latest stupid claim that the long form birth certificate posted on the White House web site is a fake. After exchanging a few messages with him I thought it was appropriate to reply publically via this blog post. Gillar has apparently now joined most of the other Birther blogs and is moderating (censoring) all comments. I think a few comments made by my RC Radio cohost Dr. Ken may have driven him to censorship. Here is my response to Mr. Gillar.

Pardon me if I do not waste even a few minutes debunking your stupid “clipping masks don’t hide things” and “Illustrator gives an error when you open a pdf with MRC compression” arguments because I have been at this for four years and I have seen every argument made by the Birthers crumble to dust. Then they always come up with something new. Birthers never explain or admit that the other 99 that got blown away. You are no different.

Let’s just look at a very brief list of myths and debunked assertions that is by far not complete:

Birthers: Obama’s middle name was Mohammed and he was born in Kenya.

Reality: He published a scan of his Birth certificate showing when and where he was born and that his middle name really was Hussein.

Birthers: It doesn’t have a seal and the number is blacked out.

Reality: The certificate was made available. FactCheck.org handled and published hi-res photographs that showed clearly the seal and the certificate number.

Birthers: There is no independent confirmation that he was born in Hawaii.

Reality: Both local newspapers carried announcements of the birth the same month. One of his teachers specifically remembers talking to the head of the department at Kapi’olani the night of his birth.

Birthers: But the name of the hospital is wrong. It wasn’t called that in 1961.

Reality: The Nordyke twins birth certificates issued the same week have the identical name for the hospital.

Birthers: But Obama’s certificate number should be lower that the Nordyke twins certificate numbers since he was born the day before.

Reality: Several other certificates from the same month are made public from August 1961 that are not in chronological order.

Birthers: Registrar Charles Bennett wrote an article in 1955 about Hawaii’s vital statistics system and said that certificates are numbered as soon as they are received.

Reality: The article doesn’t even mention certificate numbers.

Birthers: You couldn’t even play in the Little League using a short form from Hawaii.

Reality: Since 2001 at the latest the short form has been the only certificate issued. The Hawaii Little League team played in the World Series recently. They didn’t need “long forms”. Folks from Hawaii have obtained drivers’ licenses and passports with them without a problem.

Birthers: Obama could not have traveled to Pakistan in the early 1980’s on a US passport.

Reality: There was no US travel ban to Pakistan. All that was required is a US passport and a visa.

Birthers: Obama has spent millions to seal his records.

Reality: He has spent very little. The Birther “millions” claim is derived from the total expenses spent by the Obama 2008 campaign on all legal matters. The total on the FEC report was $1.7 million. The McCain – Palin Campaign also spent a similar amount for legal services. The actual legal expenses spent defending in Birther cases is much less than that according to estimates made by attorneys and probably under $20,000. In most cases US Attorneys have filed the necessary responses for the President as they are supposed to do under the law.

Birthers: The Chief Elections Clerk in Honolulu said he was told that Obama’s long form did not exist.

Reality: Tim Adams was not the Chief Elections Clerk. He was a temporary worker in Honolulu during the 2008 election period. He had no access to birth records. He would not name the person he claims him that “the birth certificate doesn’t exist”. His boss directly refuted his claims. Adams made the claim while appearing on a white supremacist radio show.

Birthers: Governor Abercrombe said “ we looked for the birth certificate and it is not there”.

Reality: Gov. Abercrombie never said that. The quote came from a radio personality who knew the Gov. but admitted he never heard that from Abercrombie.

On Minnesota’s KQRS-FM radio Jan. 20, Hollywood reporter Mike Evans, claiming to be a longtime friend of Abercrombie’s, said the governor had told him that he had searched “everywhere” at Hawaii hospitals and that “there is no Barack Obama birth certificate in Hawaii. Absolutely no proof at all that he was born in Hawaii.”

The same day, Evans made the claim on Austin’s KLBJ-AM.

Six days later, though, FoxNews.com quoted Evans as saying that he had misspoken. According to FoxNews.com, Evans said that he called Abercrombie’s office after reading online reports that the governor couldn’t find Obama’s birth certificate but that Abercrombie did not return his call. “I haven’t talked to Neil since he’s been governor,” Evans said.

Birthers: Obama’s Kenyan grandmother said he was born in Kenya.

Reality: She said on tape that he was born in Hawaii.

Birthers: Obama lost his US citizenship while in Indonesia because he was adopted.

Reality: He was not adopted and could not have given up his US citizenship as a child regardless.

Birthers: If President Obama would only spend $10 and show a copy of his LFBC this would all be over.

Reality: :LOL: Do I really need to say anything? The Birther “experts” started crawling out of the woodwork the same day it was released shouting “It’s a forgery!”

Birthers: The LFBC is a forgery because it has layers.

Reality: Compression algorithms work by assembling like elements such as text in one layer and graphics in others. Author John Woodman found hundreds of Google Books documents with similar layers.

Birthers: Paul Irey and others claim it is a forgery because there is “kerning”, multiple typefaces, and that the letters do not follow the curve of the paper.

Reality: Irey is a conspiracy nut with no experience in document analysis. Most of his so-called anomalies are the result of trying to blow up letters far beyond what the image resolution would warrant.  See John Woodman’s book and blog for details. Investigating the Obama Birth Mysteries

Birthers: Dozens of experts say the document is a forgery.

Reality: No real expert has said any such thing. WND hired two certified document examiners and neither of them supported the forgery claims. None of the Birther “experts” have ever been admitted as an expert witness in any legal proceeding where they had to go through a voir dire process.*

Birthers: The race of Barack Obama’s father is shown as “African” on the birth certificate, but next to that is a penciled number “9” that indicates “not stated.” The code is wrong, proving that the form is a fake.

Reality: The Cold Case Posse presentation used the wrong codes. The “9” code in 1961 was for “other non-white”, which is correct for the senior Obama. The CCP either was being deceptive (lying) or were themselves duped by The Daily Pen blog, who made the same “mistake”. The Daily Pen article had been debunked by Kevin Davidson months earlier when the CCP made the same claim.

Birthers: The Cold Case Posse is only out to find the truth is just following evidence where it leads them.

Reality: (See the previous item) John Woodman, who spent hundreds of hours analyzing claims about the LFBC and forgery and even wrote a book about it, offered twice to come and meet with the CCP. They refused but instead relied on characters like Jerome Corsi who has been making money on the Birther movement for years and who has been caught lying several times, and Mara Zebest who claimed the photos of the White House situation room taken during the raid that killed Osama bin Laden were doctored to add the President’s image. She claimed he really was not there.

Birthers: Obama is not a natural born citizen even if he was not born in Hawaii because a natural born citizen must have two citizen parents.

Reality: No recognized Constitutional scholar supports this view. The Congressional Research Service published a lengthy report on the subject and disagrees. The courts, beginning with an Indiana case in 2009 have ruled against this view. The fact is that anyone who is a citizen at birth is a natural born citizen.

Birthers (Actually this is a new one from Gillar himself): Barack Obama worked for Baskin -Robbins in 1974 but did not get a social security number until 1977.

Reality: Obama would have been 12 years old at the beginning of the summer in 1974. Baskin-Robins was hiring them very young back then.

I am adding this one because I found it is not the first time a Birther used the Savannah Guthrie photo in a forgery claim:

Birthers: The  word “Hawaii” is spelled ” Huwaii” in the Savannah Guthrie photo and this proves Guthrie is in on the conspiracy.

Reality: This is more shoddy work from Cold Case Posse “expert” Mara Zebest. Zebest’s original article is here and John Woodman’s debunking of this idiocy is here. John Woodman posted a copy of the Guthrie image in the original size but cropped to show only the relevant portion:

This is what Zebest used for her cracker jack analysis. Woodman enlarged the image without using the smoothing effects that graphics programs use for readability and looked at the 12 pixels that comprise both of the “a”‘s in “Hawaii and this is what you get:

So what is Gillar’s latest claim that we are now supposed to debunk after those first 100 didn’t pan out? Well just watch this video Gillar made outlining his stupendous find:

Now I could make one or two snide remarks about the production value and how Gillar is literally (and figuratively) out of focus in the video but I will not. When I watched this video all I can say is WTF is he talking about? Is this supposed to be the smoking gun? Really? Are you freakin’ serious? That’s it? After the opening music I was expecting more. I got nothing. In the video Gillar said at the 4 minute mark that he had “computer experts look into it [the smudges] and they match the color range of the pencil marks on the document”. I wonder if those “computer experts” might just be Mara Zebest (of the doctored situation room photo claim and who couldn’t get Corsi’s computer to work with a projector at a news conference) and one Garrett Papit who got trounced in comments at John Woodman’s blog when he tried to claim to be an expert on Mixed Raster Content (MRC) compression and got his clock cleaned? We do not know since Mark didn’t bother to name them.

I guess Gillar has really done it. After four years, two elections, 200 court cases, and hundreds of Birther failures who knew that a smudge on the LFBC would drive Obama from office? Mark Gillar will go down in history – or not.

So Mark, when I get a few spare minutes I might actually address “The Smudge”. It would be nice though if you would just be a man and admit how may of the myths that  I listed above that you bought into and that you know now are wrong. If you did that I might be a little more inclined to look at your little smudge. I await your answer.

*[Edited 2/2: Both Doug Vogt and Paul Irey have appeared in a legal proceeding to try to sell their analyses of the LFBC. Vogt testified at David Farrar's ballot challenge hearing in Atlanta last year. Since the Democratic Party chose not to appear his credentials were not challenged. This was an informal administrative law hearing and not a trial. Judge Malihi in ruling against Farrar said "The Court finds testimony of the witnesses, as well as the exhibits tendered, to be of little, if any, probative value, and thus wholly insufficient to support Plaintiffs’ allegations." He went on to say “the unqualified testimony of the witness [is] not competent evidence.”  Paul Irey took the stand in a state case filed by Taitz in Indiana. Judge Sherry Reid allowed Paul Irey to testify in a rather bizarre hearing over the objections of the Indiana Deputy AG. Reid then ruled against Taitz and struck all the testimony given by Irey from the record.]

It  is interesting to reflect back on 2012 and how it unfolded for the Birthers. One year ago today Orly and the Birthers were in a frenzy over the possibility of actually presenting evidence that Barack Obama was not a natural born citizen or was some kind of imposter. A hearing before ALJ Malihi was only six short days away and Malihi had already decided to let a subpoena for Obama’s “papers” Orly had filed stand. The level of excitement in Birthistan was unprecedented. Well, we all know how that worked out and the crushing Birther defeat in Georgia was to be followed by many others. Orly was to spend most of the year in the courts and she picked up a new sanction along the way when she tried the subpoena trick again against Occidental College.

The year culminated with a smashing victory for President Obama on November 6th and a last minute agreement on the Fiscal Cliff that most consider to be a big win for the President. Now let’s all enjoy Democracy at work. We have two days to celebrate the victory of reason over greed and stupidity. I plan to enjoy this. The inmates do not run the asylum. The Birthers are losers and always will be.

Today they are relegated to the corner of history with the other irrelevant conspiracy nuts.
